Ancestors of Maria Ford – sources collated by Richard Byrd

Maria Ford, the eldest daughter of William and Sarah Ford of Tortworth, was baptised in the village church on 18th April 1787. She married Anthony Barton of Starvall Farm, North Nibley, on 2nd December 1809 at the Church of St Philip and St Jacob in the City of Bristol. The witnesses were George and Elizabeth Barton. Before their marriage the couple had witnessed the wedding of James Stinchcombe and her first cousin, Matilda Ford, on 27th May 1809 at Stone.

Maria was a little older than her husband, Anthony, as he was baptised at North Nibley on 14th March 1790. They had four children who were born and baptised in Gloucestershire, namely, William Ford Barton who was baptised on 29th May 1812 (born 25th April 1811 according to the Register), George on 3rd March 1813, Sarah on 14th April 1814 and Hannah on 31st October 1815 all at Thornbury. Their father, Anthony, was described as a Farmer, late of North Nibley in 1812, as a Farmer of Moreton, Thornbury, in 1813, as a Pig Butcher of Moreton in April 1814 and as a Carpenter of Moreton in 1815.

A further reference to Anthony Barton comes in October 1815 when he witnessed his sister Harriet Barton’s marriage to Henry Sheppard in Bristol.

On Thursday 18th January 1816 Anthony Barton was one of the young men who accompanied John Allen on a poaching expedition to Catgrove Wood where Thomas Clarke, Colonel Berkeley’s park keeper with nine other keepers were concealed. This resulted in what has come to be known as the Berkeley Poaching Affray.

Anthony Barton, who changed his name to Aaron, escaped to South Carolina and his wife, Maria, together with their children, either made the journey with him or at a later date.

The family settled in Charleston where they had further children, namely, Elizabeth Mary, who was born in November 1818, and Anthony G. Barton, who was born in December 1822.

Maria’s gravestone is located at the Cathedral Church of St Luke and St Paul, 126 Coming Street, Charleston, South Carolina. It reads as follows:

4 Barton IV Gt 12 b

‘Sacred to the Memory of Maria Barton, consort of Aaron Barton who departed this life on the 26th of February 1825. A native of Wickwar, Gloucestershire, England. She has left a husband and five children to lament their irreparable loss. One who was a loving wife, one who was a mother, one who was a friendly neighbour, now in silence rested here.’

According to the “Return of Death within the City of Charleston”, Maria Barton, female, white, aged thirty-six, died of Dropsy and was buried at St Paul’s. Her attended physicians were Frost & Dickson. According to this record she died on February 27th 1825.

I give and bequeath unto John Bird of Horton in the said County Gentleman ( )

Edward Doward of Olveston in the said County Innkeeper and Richard Scarlett

of Thornbury in the said County Gentleman All that my Leasehold messuage

called the Bell (in two tenements) with the appurtenances situate in Chipping ( )

Sodbury in the said County in the several occupations of John Cook Innkeeper

and the Overseers of the poor of Dodington and also my leasehold messuage

in the occupation of William Fifield with the garden orchard and close of

Ground thereto adjoining and belonging and also all those my three lease-

hold closes of Ground now in the occupation of James Webb as my tenant (  )

thereof which said last mentioned leasehold hereditaments are situate in

the parish of Wootton-under-edge in the said County and were by me bought

and purchased of Joseph Parslow And all appurtenances thereto respectively

joint Tenants for and during all my Estate Terms and –

Interest as shall be to come therein at my death but charged

and chargeable with the Payment of the Annuity hereinafter

one Annuity or yearly Rent charge or sum of two Pounds

Arch Angel and the annunciation of the blessed Virgin Mary

by even and equal Portions the first payment thereof to begin

and to be made on such of the said feasts or days of Payment

as shall first happen next after my decease with Power of

Entry and distress on the same Messuage or Tenement –

several Closes of Meadow or Pasture Ground and Premises

last mentioned for non Payment of the said Annuity or any

Will of Maria’s maternal Great Uncle, Solomon Selman of Charfield:

 

THIS IS THE LAST WILL AND TESTAMENT

of me Samuel Selman of the Parish of Charfield in the County of (     )

Gloucester Yeoman  I give to my Son Richard Selman the sum of Two hundred

and thirty pounds and I also give and devise to him the messuage garden and

appurtenances which I purchased of Daniel Bailey situate at Charfield Green in

the said Parish of Charfield and now in the occupation of James Young To hold

 

the same unto and to the use of my said son Richard his heirs and assigns for

ever I give and devise my messuage closes lands and hereditaments with their

appurtenances situate in the Parish of Kingswood in the County of Wilts to ( )

my said son Richard Selman and my friend Thomas Neal of Wotton Underedge

in the County of Gloucester Clothier their heirs and assigns In trust during

the life of my daughter Sarah Ford Wife of William Ford to let and set the

same messuage lands and hereditaments and to pay the rents and profits thereof

unto or permit the same to be received and taken by my said daughter Sarah

Ford for and during her life to and for her sole and separate use benefit and (  )

disposal independent of the said William Ford her husband and with which

he shall have nothing to do nor shall the same be subject to his receipt manage-

ment debts or engagements and from and immediately after the decease of my

said daughter Sarah Ford  In trust to sell and dispose of the said Messuage lands

and hereditaments and the fee simple and inheritance thereof to any person or

persons either by public or private sale in the manner which they the said (  )

trustees shall think most advantageous and to release and convey the same to

the purchaser or purchasers accordingly and upon Trust to pay distribute and

divide the purchase monies (after deducting all charges and expences incident

to the sale) unto and equally amongst George and Samuel two sons and (  )

Maria Sarah Mary Rachael and Elizabeth the five daughters of her the said

Sarah Ford or each of her said sons and daughters as shall be living at her

death and the child or children of any such who may happen to be then dead

(if any) but the child or children of any such deceased child or children to take

only and divide equally among them if more than one the share or shares (  )

which his her or their respective parent or parents would if living have (  )

been intitled to and for promoting and facilitating the sale of my said messuage

lands and hereditaments I do declare and direct that the receipt or receipts

of the said Trustees or either of them for the purchase monies shall be a good

and effectual discharge to the purchaser or purchasers thereof and that such ( )

purchaser or purchasers shall not afterwards be obliged to see to the due (   )

application of the purchase money or be anyway responsible for the same

or for any loss misapplication or nonapplication thereof I give and devise

all that and those my messuage outhouses closes lands and hereditaments

with the appurtenances situate in the said Parish of Charfield (other than

and except the messuage and premises there first above devised to my said (  )

son Richard and also except the cottages gardens and appurtenances at the

foot of Charfield Mill hereinafter given to William and Zeb Cole natural (  )

children of Peggy Cole deceased to my Son in law William Fowler and his

assigns for and during the term of his natural life and from and after his (  )

decease I give and devise all the said last devised messuage outhouses closes

lands and hereditaments unto and to the use of my said Son Richard (   )

Selman and the said Thomas Neal their heirs and assigns for ever Upon

trust to sell and dispose of the same and the fee simple and inheritance (   )

thereof to any person or persons by public or private sale and in the (    )

manner which they the said trustees shall think most advantageous and

to release and convey the same to the purchaser or purchasers accordingly

and to pay and divide the purchase money to the persons and in the (  )

manner following (that is to say) To pay to my grandsons William Fowler

the younger and Samuel Fowler the sum of one hundred pounds a piece

To each of the five children of Sarah Croome deceased the late Sister of the said

William Fowler the younger and Samuel Fowler the sum of twenty pounds (  )

To Mary Wilcox Widow and Maria the Wife of John Pope two other sisters of

the said William Fowler the younger and Samuel Fowler the sum of One (  )

hundred pounds each to Sampson Fowler brother of the said William Fowler

the younger and Samuel Fowler the sum of three hundred pounds and to (  )

Elizabeth the wife of William Pope and another Sister of the said William

Fowler the younger and Samuel Fowler the sum of One hundred pounds

and to pay all that residue of the said purchase money to my grandson John Jordon the

son of the said William Fowler the elder or in case of his paying and satisfying all the

said last mentioned legacies then instead of selling the said last devised messuage out

houses closes lands and hereditaments to convey the same to him the said John Fowler

his heirs and assigns for ever or to whom and in such manner as he or they shall direct

or appoint and in case of the sale of such last devised messuage lands and hereditaments

then for promoting and facilitating such sale I do declare and direct that the receipt or

receipts of the said trustees or either of them for the purchase monies shall be a good

and effectual discharge to the purchaser or purchasers thereof and that such purchaser

or purchasers shall not afterwards be obliged to see to the due application of the

purchase money or be any way responsible for the same or for any loss misapplication

or nonapplication thereof I give and devise all my message farm closes lands and

hereditaments with their appurtenances situate in the Parish of Alvestone in the said

County of Gloucester unto my son Sampson Selman and his assigns for and during the

term of his natural life and from and after his decease  I give and devise the same  (  )

unto my said son Richard Selman and the said Thomas Neal their executors admin-

istrators and assigns for and during and unto the full end and term of two hundred (  )

years to commence and be computed upon and from the day of the decease of my (  )

said son Sampson But upon the trust hereinafter declared concerning the same term

and from and after the determination of such term and in the meantime subject there-

unto and to the trusts thereof I give and devise the same messuage farm lands and (  )

hereditaments unto and to the use of my grandson Charles Selman son of the said

Sampson Selman his heirs and assigns for ever and as for and concerning the said ( )

term of two hundred years of and in the said last mentioned premises above given

or limited to the said Richard Selman and Thomas Neal my Will is that they or

the survivor of them his executors or administrators do and shall by sale or mortgage

of the said term or any part thereof or of all or any part of the messuage lands and (  )

hereditaments comprised therein raise and levy or borrow and take up at interest the

sum of one thousand two hundred pounds within six months next after the death

of my said son Sampson and such a further sum as may satisfy the costs and expences

of raising the same and pay the sum of three hundred pounds part of the said sum

of One thousand two hundred pounds to Samuel one of the brothers of the said Charles

Selman the like sum of three hundred pounds to Solomon another Brother of the

said Charles Selman the like sum of three hundred pounds to Sampson another (  )

brother of the said Charles Selman and the like sum of three hundred pounds to Mary

the Wife of Edward Doward the sister of the said Charles Selman I give my (   )

Leasehold Messuage and garden with the appurtenances situate in the Parish (  )

of Wickwar in the said County of Gloucester now occupied by         Merrett unto

the before named Richard Selman and Thomas Neal their executors administrators

and assigns  In trust to receive the rent thereof and pay the same to my said daughter

Sarah Ford Wife of William Ford for and during her life or so long as she shall think

proper to and for her own use and benefit separate from and independent of the said

William Ford And In trust to sell and dispose of such messuage garden and premises

by public or private sale at any time the said Sarah Ford shall order or direct and

to convey and assign the same to the purchaser accordingly and to pay the (  )

purchase money into her own hands for her like sole and separate use and disposal

But in case of no sale thereof in her lifetime Then In trust upon her death to

assign such messuage garden and premises to any person or persons to whom she

shall by Deed or Will direct or appoint which Deed or Will she is hereby impowered

to make independent and without the control of her husband notwithstanding her

coverture and for want of any such deed or will Then to assign the same to her

executors or administrators I give and devise my three Cottages or Tenements with

the gardens and appurtenances belonging thereto situate at the Foot of Charfield (  )

Mill in the said Parish of Charfield now in the occupations of Daniel Bailey James

Ferris and Robert Fowler to William and Zeb Cole sons and two of the natural (  )

children of Peggy Cole my late Servant deceased equally between them and to their

respective heirs and assigns for ever I give to the before named Thomas Neal the

 

sum of Ten guineas  All the rest and residue of my money goods (  )

chattels and personal estate and effects whatsoever after payment of my (  )

debts funeral the proving my Will and incidental expenses I give unto and between

my said sons Richard and Sampson Selman my said daughter Sarah Ford my said

Son in law William Fowler and the before named William and Zeb Cole in equal shares

and proportions And I do appoint my said Son Richard Selman and son in law (  )

William Fowler Joint Executors of this my Will In witness whereof I have to this

my last Will and Testament comprized in four sheets of paper set my hand and seal

(at the foot of the three first sheets whereof I have subscribed my name and to this

fourth and last sheet I have set my name and seal) this twenty second day of (  )

February in the year of our Lord One thousand eight hundred and twenty one –

the presence of us who in his presence at his request and in the presence of each

ON the 31st July 1852 Admon (with the Will annexed of the Goods Chattels and

Credits of Samuel Selman late of the Parish of Charfield in the County of Gloucester

Yeoman deceased was granted to Zeb otherwise Zeeb Cole one of the Residuary (  )

Legatees named in the said Will he having been first sworn by Comon duly

to administer Richard Selman the son of the said deceased and William (  )

Fowler the Executors named in the said Will having survived but died without

having taken upon themselves the probate and execution thereof (at least by

Authority of the Prerogative Court of Cantebury)
